Terms and Conditions
Introduction
This Agreement (hereinafter the "Agreement") governs your (hereinafter "the User") free, time-limited, non-transferable and non-exclusive access to and use of this ROCKWOOL Calculator (hereinafter the "Calculator"). By accepting the Agreement, the User gains access to the Calculator on the terms of the Agreement. Any other use of the Calculator is not permitted.
The calculator is for guidance only and based on the data you entered. ROCKWOOL does not guarantee that the indicative calculation is comprehensive in all projects or in relation to your project. The Calculation tool cannot replace professional advice. ROCKWOOL is not responsible for any claims directly or indirectly arising from your use of the Calculator.
ROCKWOOL duties
ROCKWOOL aim to grant the User access to the Calculator in accordance with the terms of the Agreement. In the event of any discrepancy between Agreement, other agreements, or information relating to the Calculator and the User's use thereof, the terms of the Agreement shall always prevail.
ROCKWOOL aim to grant the User access to use the Calculator immediately following the conclusion of the Agreement.
ROCKWOOL strives to make the Calculator available to all users on the Internet 24 hours a day, 365 days a year, except in cases where extensive maintenance work is required. Such maintenance work is usually performed outside of regular office hours or at scheduled service windows.
ROCKWOOL does not provide support about the User's use of the Calculator under the Agreement. To the extent that ROCKWOOL provides support in accordance with the second agreement, the User will be offered such support on current terms.
Maintenance and development
ROCKWOOL aim to rectify the errors relating to the Calculator within a reasonable time of occurrence.
ROCKWOOL aim to update the Calculator on an ongoing basis to comply with laws and other regulations relevant to the Service. In addition, minor changes may occur. ROCKWOOL strives for the Calculator to be continuously developed. The user is informed about new possibilities via our newsletter.
Operating environment and data security
ROCKWOOL strives to comply with good IT practice in connection with the operating environment and data security in connection with the operation of the Calculator.
The obligations of the user
User Account, Password and Security
To use the Calculator, a named user account may be required. The user is obliged to keep password and account secret. The user must immediately notify ROCKWOOL of any unauthorized use of the account or in the event of any other breach of security.
Consent to the processing of data
The user and its users will under the use of calculator enter data in the system containing information about user projects. The User accepts that ROCKWOOL may use this data for the purpose of selling and marketing ROCKWOOL services and products to the User and third parties.
Users warrant to ROCKWOOL that the Calculator is not used in a manner or for purposes that are unlawful, including that the Calculator is not used in a manner that infringes third party rights.
Rights
The User acknowledges that all rights in and to the Calculator are held by ROCKWOOL or third parties.
Ownership and copyright of all content, all data, information and knowledge of construction physics and energy techniques and rules of construction physics and energy techniques used as part of or incorporated into the Calculator are held by ROCKWOOL or third parties. The User may only use this content, this data, information and this knowledge in connection with and as part of the use of the Calculator and in accordance with the Agreement.
All intellectual property rights in relation to ROCKWOOL or the Calculator 's name, trademarks and other characteristics are held by ROCKWOOL and may not be used in any way by the User except as part of the permitted use of the Calculator.
Rights to the databases and the content that the User may transfer to and store on the Calculator belong to the User, as ROCKWOOL may only use these databases and this content in accordance with the Agreement and applicable law.
ROCKWOOL strive to that the data in question will be made available to the User for a reasonable remuneration after the expiry of the Agreement, emphasizing that it is the responsibility of the User himself and independently of the Calculator to copy this data and this content before and during use of the Calculator in a format that the User deems appropriate.
Liability
Parties in breach of the Agreement n liable for Danish general law of damages.
ROCKWOOL does not warrant that the Calculator will not infringe any third party's intellectual property rights. If it is determined that such a violation has occurred, the Member may not make any claim against ROCKWOOL, unless there is gross negligence or wilful conduct by ROCKWOOL's side. The User is in cases where continued use of the Calculator is not possible due to a violation of third party rights and there is no gross negligent or intentional behaviour on the part of ROCKWOOL, merely referred to cessation of use of the Calculator, since no compensation may be required from ROCKWOOL in this regard.
Immediately after being granted access to the Calculator, the Customer shall examine and test the Calculator. The calculator is used by the User as a busy. If the use of the Calculator does not live up to the expectations of the User, the User is directed to cease using the Calculator alone. No further claims, including claims for damages, may be directed to ROCKWOOL for that purpose
ROCKWOOL shall not be liable for any consequential loss or loss, indirect or special damage or loss, whether based on lost goodwill, lost profits, loss of use and loss of data (including the User's data), or interruption in use or the availability of the Calculator , any other software or equipment, the interruption of other work, the deterioration of other assets, or otherwise, whether such damages or losses may result from breach of any warranty, gross or simple negligence, incorrect information or any other act or omission by ROCKWOOL 's side under or outside the agreement.
ROCKWOOL is not responsible for any non-performance of the Agreement due to reasons beyond ROCKWOOL 's control which could not be avoided or foreseen by ROCKWOOL at the time of entering into the Agreement, including causes related to support and maintenance, professional conflicts (strikes) and lockout), incapacity of key personnel, war, riots, force majeure, fire, currency control, public seizure, embargo or interruptions of the ordinary means of communication or energy supply.
ROCKWOOL is only liable for damages caused by the Calculator (Product Liability) to the extent that such liability is prescribed by applicable law.
Privacy
User warrants that can be processed personal data covered by the Privacy Act (the Act on processing of personal data) in connection with the User's use of the calculator.

Agreement
The Agreement starts once the User has accepted the Agreement.
The Agreement may be terminated by ROCKWOOL upon written notice of 30 days, the termination being effected by e-mail to the User or via notice provided as part of the Calculator or in connection with the User's use thereof.
No termination notice applies to the User, as it is free to use the Calculator at any time.
Upon termination, the User's access to use the Calculator is terminated without further notice and data, and content associated with the User's use is deleted.
Transfer
The User may not transfer any rights or obligations, including the right of use granted to the User under the Agreement, in whole or in part to any third party without ROCKWOOL 's written approval.
However, notwithstanding clause 10.1, the user is entitled to allow the third party to use the Calculator in connection with such projects and directories created by the Customer in connection with the use of the Calculator. However, the use of third parties must always comply with the guidelines for this which ROCKWOOL may notify the User.
ROCKWOOL may assign any right or obligation assigned to ROCKWOOL under the Agreement in whole or in part to any company in the ROCKWOOL Group.
Law choice and venue
The Agreement is governed by and construed in accordance with and governed by the laws of the Kingdom of Denmark, with the exception of the Danish provisions on the choice of law.
Any dispute that may arise as a result of or in connection with the Agreement must be settled by the Court in Roskilde.
